Dear Attorney Manoff:
    I am responding to your letter of July 22, 2004 and to our conversation that took place today. As I mentioned, one item that I was trying to determine was the size of the company. That has been resolved somewhat by the disclosure of the settlement with the attorney general of Washington state and it allows me now to go forward with a fair proposal.
    The substance of my proposal as outlined in my July 20, 1994 is based (in my belief that DSI deliberately defrauded the public based on the nature of the plan itself and this practice is more egregious than the telemarketing. and sales practices outlined in the settlement notice. The combination of the two, if presented to a state or federal jury or other attorney general’s could result in much more significant damages and the possibility of jail and certainly the shutting down of DSI. A point not to be missed is that the practices I uncovered were taking place while the state of Washington and. maybe others were in the midst of an ongoing investigation.
    DSI indicated that it had saved me $66,339.77 when, in fact, it knew that it had not saved me any money but in reality cost me many thousands should I follow their plan. Therefore I am asking for compensatory damages in the amount listed, for this would be the only way that DSI could show me the savings they printed in their plan. Furthermore, I am asking punitive damages of 10 times compensatory, an. amount within the guidelines recently established by the United States Supreme Court, for a total settlement of  $729,737.47.
    I suggest an initial payment of 60% ($437,842.48) and the balance of $29 l,.894..99 be paid in 36 monthly installments of $8108.19.
    Addressing your need for assurances, I will not initiate any legal action, either civilly or through other attorney general’s offices. With the Washington settlement in hand I could prompt action in a number of other states as well as find any number of attorneys interested in a class action due to the numbers involved.
