Complaint - Beyond Fitness, (aka) Gold's Gym
Date:
   09/24/2003

I have a membership with Beyond Fitness, (was Gold's Gym) and I moved in July to Atlanta, GA. In June (one month prior to the move) I filled out the proper paperwork to end my contract with them. Unfortunately they have continued to bill my credit card for months and now state that I owe the company close to $800.00.
For some reason, the company did not charge my visa account over the course of March and April. There was not reason for them not to charge the account. However, they are now stating that because of this, my account is in bad standing and they will continue to charge my account.
I am amazed by the lack of customer service as well as their bold stealing of money out of my account. It is my hope to resolve this issue ASAP. It is also a great concern to me that they have sent this to a collection agency when in fact they owe me money.
    PLEASE HELP!!!  -    WBR

 Complaint
Business: BEYOND FITNESS/GOLD'S GYM/AFFILIATED ACCEPTANCE CORPORATION
Subject: Company   NA
Description: I signed up with Gold's Gyms back in 2006 along with the Beyond Fitness trainers. I went for about 4 months and had 3 different trianers. Then our last trainer was let go. We were contacted from another trainer to set up appointments and when I told him the only time we had to train, which the other trainers were able to do, he said there was no other trainers at that particular time. We did not get another trainer and therefore "THEY BROKE THE CONTRACT" not my husband or I. I still made payments due to the fact I did sign a contract, but never went back to Gold's Gym after that. I have sent in letters to both companies when it was time to cancel and they tell me they never received anything and that I still had to pay the fees for continuing the renewal. I have tried and tried to get things resolved without much result and they keep telling me I owe them, when in fact they owe me! Gold's Gym did admint they made a mistake on thier part, however only gave me one payment fee back. Beyond Fitness says there is nothing they can do and that I had to pay to get my acount current with them and then send a certified letter to them to cancel with them. I had to put a stop payment on my account so they would no longer charge me monthly. What I don't understand is that I was not charged for a year after my account with them was over and then all of a sudden in February of this year under a different name and no way to contact them, they charged my account each month. I NEVER gave them permission to take money out of my account. I had to dispute with my banck and it took until September to finally put a stop payment on them because of thier "unknown" name on my bank statements. I was only refunded for 2 months though and then I receive a letter from Affiliated Acceptance Corporation saying I owe them for the stop payments, late fees and evrything else. I finally called the customer service that was provided with the letter and they tell me there is nothing they can do, because they never received a letter from me and it was not "certified" (which was a mistake on my part) and that I will have to pay them all that money to bring my account current and then send them yet another letter of cancelation certified for them to stop charging me. THEY BROKE THE CONTRACT!!!! I am struggling money wise and don't know what to do. Any suggestion? Any lawsuites going forth on this company that I may be a part of or search on??? PLEASE HELP!!!!!

Description: Well good old Professional Fitness is up to their old tricks again. I have a contract with them for personal training and they are no longer in my location where I pay good money for a membership. They say I have to pay them any way even though they dont provide the service anymore. They tried to get me to join another gym which I dont want any part of. I am a member of the Spa and I will STAY there. These people need to be stopped. They only care about money and not about the clients. They are supposed to be a personal training company and they are far from personal. The trainers are great. As a matter of fact I started training with them for my trainer not to be apart of their company which is all about getting money for services that they cannot provide. They are no longer in there because they do shady things with peoples credit cards. I have a friend who even had a guy FORCE her down payment through. This is an option that they used if a card declined. They could make it go through making them over limit or negative in their bank. What kinda business is this. Then I found out that an upper management guy from their corporate office was the one who instructed his guys to do this. This is the type of peopl whos running this company! DO NOT USE THIS COMPANY THEY NOT WHATTHEY PRESENT THEMSELVES AS! DONT BE FOOLED!

Description: I had a contracted with Beyond Fitness back in 2005 who was working with the gym I had a membership with "The Spa Fitness Center" (Fayetteville, NC). I had about 2 sessions, then the trainer quit. I was suppose to be re-assigned another. Needless to say I never got one. I tried in vain to get with another trainer. I was told I couldn't cancel the contract, it was up to me to find a trainer on the roster and make appointments. I soon moved about 40 miles away so I was hoping that would allow me to get out of the service. No dice. I was told my the cooperate office that I could pay the full 3 years up front or I could keep getting charged monthly. It is now 2008 and my bank account is still being charged monthly. I have written letters, called... you name it. Recently Beyond Fitness changed their name... but they still wont stop charging me even though the contract is up. The only thing I can think to do is close the bank account. I am so pissed off about it.

Question is , has anyone actually filed legal actions against this company and if so what has been the outcome? I live in Utah and would like to proceed with a law suit in early 2008. I would like to hear from those who have proceeded legally with Beyond FItness in the past.

Business: Beyond Fitness
Subject: Company   NA
Description: In January 2007 I moved from Utah to Missouri. Since there were no Beyond Fitness locations in Missouri, I began the process of requesting a relocation buy-out in February. I followed their procedures, sent all the necessary information, proof of move and $100 cancellation fee by way of certified mail. I was married in February also and I sent them my marriage certificate along with the phone bill with my new husband's name. They called me and said that I had to send them a mortgage or utility statement with my name on it. I explained that my husband has the mortgage in his name and all of the and utility information was in his name only and that's the way we wanted to keep it. They told me that I would have to have my husband prepare a lease agreement for me to sign. I told them I thought that is was ridiculous to ask us to prepare a ficticious document just to prove my residency. I then faxed them a bill from the clinic where I was an obstetric patient, thinking that this would obviously be a logical way to prove that I resided here. After all, why would I seek prenatal care all the way cross country? They said that wasn't good enough, then I sent them a bank statement with my new address. They said that still wasn't good enough. Well it's now June 29 and I still haven't been cancelled and have still been charged fees for March, April, May and June. They "say" they are going to cancel my policy finally but are not going to refund me for any of the months that this has taken to settle. Their customer service reps are terrible. They don't call back when they say they will, they neglect to respond to faxed correspondence and they refuse to let you speak to anyone in authority over them. They were very rude and hung up on us when trying to settle this matter. They are cheating people out of money all over the place and I am so glad that I found this site to complain to. This company has no business being in business!

Description: I Joined Beyond Fitness in 2003 in Lexington, KY at the Richmond Rd.Gold's Gym location (which is now closed). For the first few months everything went well until my trainer was relocated to Louisville, KY and never replaced. I attempted to obtain another trainer at that location and was unsuccessful and eventually decided to cancel my contract. I spoke with Colleen at the Corporate office and at the time she would not resolve the issue or cancel my contract because she was going on vacation to Michigan. I had to stop payment on the account and four years later I am still waiting for her to return my phone calls. My account has been turned over to a collection agency, and they will not provide me with any company information or how to resolve this issue. This preventing me from getting aj ob, because I have an account that is past due. If you have any solutions please email me at emblandford@hotmail.com

Description: I just wanted to say thank you to everyone who has posted your complaints with this site. I signed up for Beyond Fitness and had 2 training sessions. When I went in for the third they said I had been assigned to a new trainer who had called in sick and would contact me at the end of the week to reschedule. The end of Thursday rolled around and I hadn't heard from anyone. So, I decided to do some research before contacting them and luckily found this site. I contact my original trainer (who happened to be a manager) and luckily found out my paperwork hadn't been sent in to the corporate office yet. I was able to obtain my original contract, my initial check (for 399 dollars) and the cancelled check that would have allowed them to make monthly withdrawals. It was nice driving home that evening with an $1800 dollar weight off of my shoulders. Thank all of you for making your stories known.

Description: I too have a similar story with Beyond Fitness. I read the contract and followed the specific directions to cancel my contract and they are still trying to pull money out of my account. My back told me that the only way to stop the jerks is to close that account and reopen a new one. They must be VERY used to scamming people because they have not contacted me once since I sent out my certified letter of cancellation but did send me to a collection agency 1 week after they realized they couldn't get paid. A friend advised me to contact the Better Business Bureau and I am pleading with all the people that have been screwed over by this company to do the same. After that course of action, we also have a news channel that runs a program on shady companies and i will be contacting them after collecting as much evidence against Beyond Fitness as possible.

Subject: Company   NA
Description: I must start off by saying that I apologize to any individuals that may have been mistreated or misguided by beyond fitness. I actually use to work there as an employee and know a little bit about how it works. First of all I would like to say that I feel that the problems of course......all stem from the management of the company. The leaders and top executives seem to have a powerful and compelling push for sales and not enough drive for customer satisfaction. Any customer satisfaction received will come from the actual trainer themselves. Most trainers that I have seen as of lately in the area that I am in are very good trainers and well qualified. But very much underpaid and undertrained as far as what they are alowed and capable to do. Most traines are paid a small portion of money for each session and then any extra time they spend at the gym is on there own time. There is very little training that is entailed to the minute but important details of customer service, however most trainers go out of there way for there clients because of the relationship that is created. All I am saying is that Beyond Fitness lacks a strong leadership within the company that has motives of service. Its all about how much and what more can you produce. There is not a culture that is focused on what can I do for you? How can I help you out? This is because of lack of leadership, and lack of training. What goes on down there at headquarters is oblivious do us trainers that are far distant away. Most companies have mission statements mottos visions and standars that they go by but there is no such thing here at Beyond Fitness. Hard pressure on production but no fine tuning and lubrication going on with the customer service. I have been with Beyond Fitness on and off for the past couple of years and have seen some improvement taking place within the company. However this culture that has been created will not be changed until it changes from the top!! I repeat that this culture will not be changed until leadership decides to lead and start caring about customers and employees. You may feel like things were not completely upfront, but I must tell you that is how things are not only with customers but with employees. The company should treat there employees like they would treat there best customer!! See the problem they are not treating there customers very well so you can imagine the way they treat some of there employees. All in all remember that this is a company ran by quotas and people feel coerced and compelled to do what is neccesary to keep there job. please remember that many of the trainers themselves are there because they depend on the job and have no other options that they can take. But I know that the trainers themselves are taking the neccesary steps to try to help serve you in any way possible. Remember that Beyond Fitness is at the mercy of the gym that they are in! if they fail to satisfy you as the customer, not only do they hurt there own business but they also hurt the market of the local gym they are within. Most gyms will only take so much before they will threaten to throw Beyond Fitness out. The fact of the matter is most employees for Beyond Fitness don't know that much about the contract. There is no trainings specifically on the contract. Now as a manager you learn about the contract but not in very much depth. There just isn't a whole lot of information that the employees themselves receive. The only advice I have at this point is make sure that you get what you want! Make sure that things happen for you! You deserve good quality care, you deserve to be served in any way possible. I don't actually have a lot of knowlege that can help you, most of you have more knowledge then most of the workers. They are not lieing when they say they don't know what happenned or what to do. They refer you to corporate headquarters cause that is what they have been told to do. I know that most must be very frustrated and that is understandable. But don't be taken advantage of, make sure that the right things happen, make sure that you get your money back. Also if you are feeling ignorant right now check out your contract read it and understand it before you make the call. or if you have not yet signed up with Beyond Fitness just make sure you know the contract and what you are getting yourself into. Also make sure the managers of the gym know that you are upset. They do not directly belong do Beyond Fitness (Beyond fitness is separte from most gyms) but what you think affects both Beyond fitness and the gym that supports beyond fitness. And beyond fitness is at the mercy of the gym. good luck to all of you that have been mistreated I hope that you will receive recompense and restitution

Description: I was happy to originally sign up for the services of a personal trainer with Beyond Fitness (gold's gym) and after the company let go my trainer and in turn set me up with several unsuitable replacements I decided to discontinue my training. I did however continue to pay the agreed monthly payment until 3mo before my agreement ended they were all of a sudden unable to process my payment. This in turn made my account delinquent. I after arguing with a company rep. again agreed to pay the full balance which now included over $100 in late fees. A month later, after my agreement had completed its 1yr term, after I had paid the account and its unwarrented late fees, and after I had spoken with multiple company reps about my wish to cancel the account I recieved another bill. Again stating my account was delinquent and on top of that my subscription had been renewed for another year. This is a HORRIBLE company to deal with. They will continue to try to take you money even after you've bent over backwards to be compliant. I will never do business with or promote this company again....not even to my enemies.

 Complaint
Business: Beyond Fitness
Subject: Company   double charged
Description: I paid for a personal trainer for 48 hours of training from a company called Beyond fitness working out of Gold's Gym in West Jordan Utah. They charged me $1959.00. $1400.00 I charged on a credit card the rest by check. Within a few days the corporate headquarters double billed my credit card another $1400.00. Once I saw this I thought I would just go down to the gym and tell them to electronically add the amount back to my card. When I arrived one of the trainers asked me to prove that it even happened. And then he told me if I had proof that he could take care of it right then. I brought all the proof down to the gym a little annoyed that I had to even prove it and make an extra trip, since they should have records as to what they did. Anyway upon seeing the proof and I gave it to him. He told me he would get with his manager and it would be taken care of and told me he would call me that same day. He never did. A few days later his boss called me and asked me to give even more proof and then gave me the number of the corporate office to call. They again wanted proof so I faxed it to them. The corporate customer service person admitted that I deserved a refund and said it would happen in 30 days. Thirty days went by and I received nothing. At that point I called back yet again. They informed me once again that I was going to get the refund and that it would be mailed to me. I asked him if he had my address to send it. Which I know he did since I had faxed it to them several times. but when I asked him to repeat it he kept getting it wrong. His demeanor instilled no confidence in me that I would ever get it. I could tell from his voice that they had no intention of even sending it but I had little recoarse but to wait yet another month. Then I called yet again and I was told that the check had indeed been mailed out from North Carolina on March 7th, 2006. The current day of this call was March 11th. I said to customer service rep that I probably should have received it already if it was truely mailed that day. She told me that if the mail did not arrive it would be returned to their company upon which they would fedex it to me at that Point. Today is March 14, 2006 and still no check. I have read a record on your site that I am not seeing now that talked about an former employee that said they on purpose double bill lots of people and then are slow to repay or don't repay and make lots of money from the interest. I really think this is what is happening. I don't believe that this check was ever mailed and I don't expect to receive it. I think they are going to string me out for months to come. This company is the lowest of the low. I have not been using their services and have only used 9 1/2 hours of the 48 hours I paid for. I really want all my money back not just the $1400.00 because I am so upset with them I really can't even go to the gym and work out, I just see "RED". I am thinking about getting a lawyer now and possibly advertising looking to see if this has happened to other people because I think it has! The trainers at the gym just tell me that the corporate office is terrible and advise me to sue them (this is the advise of their own people!). But they offer no possibility that I can even get anywhere with them. I have read stories about the employees being unhappy as well. I believe I read them on this site. Plus their trainers at the gym I signed up at tell me what a terrible company they work for! I saw 30 pages of complains but now all I get is a database error and only see the first record on beyond fitness. I could really use seeing these records again can you fix this. Might need it. Since in my letter to them I sent a copy of your page showing some of the complains I am wondering if Beyond Fitness has contacted you guys and is trying to surpress any bad reports. I would hate to think this is happening. I am sure that 9 people out of 10 get worn down and let Beyond fitness gets away with this bad behavior. Not me I am that 10th person and I don't intend to drop this until justice is served. I have all the documents and we have a tv new person in town that handles just this sort of thing. I intend to have it aired on tv if necessary. What ever it takes.... I have the moral High ground here and Beyond Fitness shouldn't even be in business if this is how they intend to treat customers! All their excuses are just to keep the money a little longer or permanently. I don't believe a word they say! I believe there are X employees that know what they do and I would like to contact them. Can you help!

Description: I used this company for a few months. I was told when I signed up that the only contract I could sign was a one year. After 6 months I found out that this was a lie. I then tried to resolve this with the company but they don't seam to care. I feel that because I was lied to they should not hold me to the contract, especially because i did use thier services once I found this out. I would suggest to anyone interested in beyond fittness or affiliated acceptance corporation, RUN! DOn't sign anything with either company they are going to screw you one way or another.

Business: Beyond Fitness
Subject: Company   NA
Description: I am a member of Living Well Lady Fitness Center,an all female gym: 8210 Mills Drive Miami, FL. 33183. On April 4 2005, I signed a personal training contract with Beyond Fitness for 3 sessions a month, at $90/month, for 6 months. An automatic payment was also made in October and then another in November so as to fulfill my obligation to provide 30 days notice and written cancellation. I did this to remain in "good standing" which was suggested by their payment service, in order to have any chance of a refund. Unfortunately, I have been unable to use any of these sessions due to a foot injury and two subsequent surgeries. After my first surgery, 6/9/05, I was disabled from training from April to October. When I returned to the gym I was informed that Beyond Fitness was no longer providing services at this facility. They referred me to Gold's Gym, a coed facility located at 1617 SW 107 Av. 33165. I requested a full refund of all my unused personal training sessions because my membership is at Living Well Lady, an all female gym and I will not train at a coed facility. The Florida Consumer Protection Code (501.017) stipulates a facility of "equal quality"; Gold's gym is a coed facility which is certainly not a facility of "equal quality". Additionally, according to both Mapquest and Yahoo, Gold's Gym is more than the 5 miles stipulated by the same code. I have requested a full refund based on these facts alone (besides the fact that I had additional surgery on 12/14/05 and am again unable to train for the next several months). I have written and called the company several times requesting a refund but they have refused. I've sent registered letters to their corporate office in Atlanta, GA. and to a customer service person, Jerena Grimn, in Raleigh NC. They have refused to refund any of my money, saying that Gold's gym is within 5 miles, and because some of the trainers are male that the "female gym" issue is not valid. I have filed complaints with both the BBB in Atlanta, Geogia, and Consumer Services in Miami, FL. Both have been unable to resolve this issue, or even get a response from the company. I have all the documetation and can foward it to you if neccessary. Do you think you can help? Thank you in advance for your efforts.

Description: I WAS a member of Golds Gym in Wilmington NC until I delt with "Beyond Fitness".I signed up for training with this company and was told that I would be trained by the young lady who signed me up.This did not happen, inside of a few months I had 3 different trainers! I learned later that the girl who had signed me up was fired because she was hired at a certain pay rate and later Beyond Fitness said they wouldnt pay her that rate contract or no contract, when she brought up this injustice to the managment thay fired her. This should have been clue #1 that this company is crooked. They get their money every month from me and I get trainers that either don't show up or know NOTHING about what they are doing. When I spoke to the supervisor for Beyond Fitness she seemed to not care. When I tried to contact a home office all I got was a voicemail box and a fax machine. In my own investigation to find someone to cotact I found PAGES of complaints against this company Beyond Fitness.107 in the last 2 years,86 were not handeled by the company. I also found that some of the owners have criminal records involving things like drugs and even GUN RUNNING! This company is run by crooked people who do crooked business. I have never found so much negative feedback on any company and it still be in business.DO NOT DO BUSINESS WITH BEYOND FITNESS!!!If you search this company online you will find complaint after complaint and even a few "trouble shooter" news teams that have went after them.Beyond Fitness is a bad company with a bad reputation.

Description: Here is some information about the Beyond Fitness Personal Training services and the gyms in the Raleigh area. When looking into a contract with BF for the training department, ask the rep that you are with a few simple questions. Question #1: ask if you can meet with all the trainers on staff that way you can decide which trainer is best suited for you. DO NOT let the general manager pick this trainer for you. Would you let a car salesman pick a car for you if you didn't test drive it? Make sure the chemistry is there and make sure the trainer can and will provide the results that you are looking for. #2: Many complaints about the training department are about the trainers missing appointments. On the back of the contract, it will state the company has to provide you a service of training. If your trainer is not available and another trainer is, take advantage of this situation and use this new trainer. It may workout to your advantage because if you don't then the company is NOT in breech of contract. They have a person(s) on staff to provide you the service, you were just upset that your trainer was not there so you left. This new trainer may never be late, may have great and new workouts and may care about you. #3: Watch the trainers in the gym before you sign up. What are the mannerisms of these individuals? Are they on time (sessions run on the hour and 1/2 hr's)? Do they get excited about the client and his/her workouts? Do they walk the floor and help others when they are not with anyone? These are VERY important qualities in a trainer. Most of the time, the customer service issues do not come from the training department but the corporate office itself. For that I want to sincerely appologize. The trainer or the general manager gets in the middle of it all. So be patient as much as you can, because most of the times, his or her hands are tied and they can only provide information that is provided to you. Last but not least, get it in writting from the general manager of the training department, that if for what ever reason you need out of your agreement, you have all the methods necessary to do so (addresses, phone #'s and payments : 15% of the remaining balance or $250.00 whichever is greater)

They lie about the auto renewal, do not stop debiting your account even after you send a certified letter and when you talk to the manager you get insults and rhetoric. Also, they tried to dupe me into allowing them to send the necessary letter to Raleigh which I am sure they had no intention of sending. Angela in Raleigh lied about the address to send the certified letter to and what to do to cancel the auto-renewal. They have stolen over $500. from me and threaten to file against my credit if I stop the payments. I am in the process of filing an affidavit with my bank to secure any money they try to take. I am also interested in a class action suite if there are others. And I am fighting at the local level. I have cost them 5 memberships and I will continue to speak out against them unless they refund my money. They have already lost more than they stole from me and I have just begun. Description: I joined with Beyond Fitness at Durham NC site in October 2004. I signed for a year contract. When my contract time had expired I went to the store to ask what the policy was for cancellation. i was told I could not do it in store but I had to send in a form (which the rep provided) to the corporate office in order to cancel. No biggie. The form stated that it needed to be completely filled out and sent in certified mail. Which I did in October 2005. November 2005 I got an invoice from Beyond Fitnesses billing company Aphelion saying I owed for November then I got one for December. Confused as to why i was still getting billed I called. The rep-Donna said that they never recieved any certified mail or any cancellation form and she said that my contractis for 2 years. Now I have to go through the hassle of proving to them (with reciepts, etc again) that i did go through the proper channel to cancel and pay my account. Dealing with this company has been a headache. The people at the Durham Gym were nice but beyond that the company sucks!

Description: I entered into a contract with Beyond Fitness in July 2005 and it is now Jan. 2006 and I have yet to get a card! They didn't bother to send me anything regarding who was taking my money out until a month after they took it out and I filed a fraud claim. When I signed up I told the man that my insurance company was to pay $20 of it once a month after I visit the gym 8 times or more, he had no clue to what I was talking about. They didn't take money out until November and it was scheduled to be withdrawn in August. I moved in October and thought nothing of cancelling since they haven't lived up to their end the of the contract. I tried to call them in November once Duvera Billing withdrew money out of my account and told me to call headquaters and each time I called I could never get anyone on the phone and I can't find an address to write them either. Now I have this 866 number that keeps calling, but can't and doesn't care about me before they called. They are calling fradulantly having my phone number come up on the caller id as well! How do I get them to stop?

For 3 months, Beyond Fitness has not returned phone messages, certified mail or even attempts for the Better Business Bureau to discuss out complaints. My husband was not give any session after the first visit. The Trainer would not return phone calls to set up sessions and was fired within a month. we feel the contract was voided by Beyond Fitness since they did not provide services that were outlined int he contract. We recently recieved a call from Beyond Fitness only because we had stopped the drafts from our checking account. No that we have a number to their customer service department we have found that the staff has no customer service skills and had no interest in us - only our money! I have pleaded with Peak Fitness to help fix these issues. Any suggestions on creative ways to stop this company??? We feel they will not show up if we sue them and never see the money we are rewarded. So we need alternate ways to find justice!

Description: I signed up with beyond fitness at Golds Gym of Hope Mills, NC in July of 05. They took my 279.00 down payment and put it on hold than it came off hold but never out of my account. I said something to my trainer about this (there is no number on the contract to call) and he told me to hang tight the money will come out. In October of 05 I changed my credit card number with the company and asked about the 279.00 payment that had still not come out. I was told the money would come out off the new card number. I payed a 34.00 wire transaction fee to move the money from the old bank to the new one. Here I am in December (on my second trainer who is about to leave so I am now working on my third)2 weeks before christmas and they take the 279.00 off my old card sending my account almost 600.00 in the negative. I call everyone I can about this having one person after the other give me another number to call. Finally I get 919-827-4663 a customer service number where I talk to a girl named Jessie and she transfers me through to another woman who tells me this is all my fault that the money did not come out of the right account and that I should have called her sooner! Never mind that I called the finance company in October and they told me that the money would come out of my new account and never mind that I told my trainer and he told me to hold tight the money will come out. This is all my fault and that woman is sorry but there is nothing she can do! So my christmas is now shot to hell because my next check will cover all these over draft fees not my layaway!

Description: I signed on with Beyond Fitness at the local Gold's Gym 11 months ago. Beyond Fitness religiously charged my credit card on a monthly basis. At about the 6 month mark the Beyond Fitness trainer(s) started complaining about not getting paid and that the company was unresponsive to their complaints. (Why they continued to work without getting paid I do not know.) About a month ago I was told Beyond Fitness filed bankruptcy and a new company called Custom Built is taking over. Same managers, employees, etc. Just new name. How can a company file bankruptcy and simply change their name and continue operating? It is in fact a new company because the trainers had to complete all new newhire paperwork. The trainer(s) are once again not getting paid and mine quit. I was informed there is no one else to train me. Now my card is being charged by a company called Affiliated Acceptance Sunrise Beach. Meanwhile, the contract with Beyond Fitness states that you must inform them 30 days in advance........in writing......to cancel the contract after 12 months.......yet there is no one to write to because apparently Beyond Fitness does not exist any longer. I reported my credit card stolen to stop payments.

Description: It appears that I too have been scammed by Beyond Fitness. I signed a contract last year, was in an automobile accident which disabled me to the point of not being able to attend the fitness sessions. I was then told that the sessions I had missed would be accounted for, allowing me to make them up at a later date. The trainer I was seeing mysteriously left the face of this earty as no one in the company knew where he had gone off to, so I was transferred to another trainer. This trainer let me in to the truth behind Beyond Fitness, all of which is previously stated on various comlaints within this page. I still have a few months left of my year-long contract with Beyond Fitness, however, do not have a beyond fitness trainer within 35 miles of me, and am at a loss with how to cancel this contract. I have placed several phone calls to various beyond fitness locations, the "corporate office", etc. This is extremely stressful, furthermore, I am only 19, my income is only about $350/month of which $280 is being given away to this company which can not even fulfill our original agreement. I was more than willing to meet up with a fitness instructor, I even drove 35 miles one day to meet with the "nearest trainer", that is just absurd. If anyone has any advice, I am truly at a loss here, please contact me at jessaye@gmail.com. Thanks

I called the number on my credit card statement. It went to a nearby location. They said I had to come in and get the form to cancel membership. A few days later I went in to get the form. Well they "couldnt find any" forms at that moment. I left my name and address and asked them to mail me one. They agreed. It never came. I called the number again and it said the number had been disconnected. so i tried some other numbers for other area locations and THEY ALL HAD BEEN DISCONNECTED. So I give up! I closed the credit card account, so they cannot charge me anymore. I cannot figure out how to tell them that their records for my former last name and address are incorrect. Description: I am one of the suckers that signed up for a personal trainer through beyond fitness in West Jordan. I have tried to cancel my membership due to a family illness. I am unable to do so and am looking at a 504.00 penalty. The woman in charge suggested I fake a doctor's note to enable me to pay just 100.00 and cancel my contract. I am not able to find a doctor who will fake a note for me so I guess I am on my own. Do not under any circumstances go within 100 feet of Beyond Fitness. They are evil incarnate. They take advantage of people who are just trying to better themselves. Anyone out there who would like to file a group lawsuit...Let me know. I would love to get these people where they live.

Description: I joined Beyond Fitness in August but I noticed that my account was not being charged. When I asked someone about it they said it would be 2 weeks before I was in the system. After the 2 weeks I was still not in the system so I stopped going and moved to DC. After 4 months I get a call from one of the rudest people in the billing headquarters. After sorting out the mess Beyond Fitness made out of my paperwork, I explained to her that I moved and she quickly replyed with "I dont care where you live." She proceeded to tell me she would take me off e-billing and I would have to come to Raleigh and sort it out in person...Only she CHARGED MY ACCOUNT WITHOUT AUTHORIZATION! How could I be responsible for a membership I NEVER HAD in the first place? I do not recommend this gym to anyone that values their money. Try Planet Fitness on Western Blvd.

I was not charged the month to month fee for July, but all of a sudden the $30.00 payments have been debited out of my account for the last three months, meaning that my contract was extended without my consent. While signing the original contract I was NOT informed by the representative (Sheron Petty) that I was to submit in writing a notice of cancellation 30 days prior to my contract expiration date.  Complaint
Business: Beyond Fitness
Subject: Company   NA
Description: I joined Gold' Gym in Jan. 2005. I received a free session with a trainer from Beyond Fitness. The regional manager, Mike, took me through the hard sale and asked me what my goals, committment, etc were. I decided that I did need help in starting me out on a correct course in my training. He told me I had to pay the first and last month's fees but I could quit at anytime with a 30 day written notice. To determine the monthly cost, he quoted me a table based on 1 time a week is $100 a month, to 5 times a week is $500 a month. I decided I would sign up for the 3 times a week for $300, thinking that I would stay with it between 4 to 6 months. The trainer he set me up with was sent to another gym when I showed up for my first lesson. The next lesson my trainer explained that not only did he work at another gym across town, he didn't work the evening hours that I needed due to working days. So I even drove across town at first for one of the days a week to work around his schedule, which was a 12 hour a day/6 day a week work schedule that began at 6 a.m. in the morning. By the time I arrived, 6:30 p.m. he had put in a 12 hour day and he was burned out. I continued to work with him for 5 months until he was promoted to a manager. I asked for a woman trainer and I got a very competent upbeat girl trainer who became sick in a month and had to quit. No one even contacted me to set me up with a new trainer. I finally had to call my last trainer to find out who I called to be set up. I was happy with the new trainer and felt shewas very competent but I also got the feeling that she wasn't happy being there and then she got very sick and had to quit. Then I was on my own again and I went back to my old trainer again to get lined up again with a new trainer, again. I really liked her and she was very serious about my plan and goals, plus she was a lot of fun. Unfortunately, she only lasted for approximately 2 months and then she moved away. I am now on my 4th trainer and she is very competent and I like her very much. After I lost my first trainer in June I was not very happy with Beyond Fitness' lack of concern for me and I wasn't feeling like I was benefiting from them at that point, I tried to give my 30 day notice to quit. Well, I found out that I was committed for the full 12 months and if I wanted to quit I had to pay either the remainder of the contract or $250, whichever was less (which was in fine print on the back of the contract of their copy). I also had to pay another $300 for the 30 day notice period and another $300 for the last month's fee. When I told him that I paid the last month's fee upfront when I joined, and that they took the $600 out of my debit card, Mike said that wasn't the last month's fee but a sign up fee because they had to hire a trainer for me. I was furious at how he had blatantly lied and deceived me. So now he was telling me it was going to cost me $850 to quit. I asked for the address to send the notice to, because up to that point he didn't want to give it to me. I was determined to take my losses and quit, and then after I had met my new trainer, I decided to continue for a few months. I later discovered that Mike also cheated me out of sessions. When he told me that I signed up for 3 times a week for $300 a month, I figured I had 156 sessions (3 x 52 - for # of weeks in a year). I then found out that he had me down for 3 times one week and 2 times the next week, which adds up to 130, shorting me 26 sessions. That is very substantial in my book - 8 1/2 weeks. I am not a stupid woman, and I know what I was told. I asked my trainer to look at my file and all those pages of the payment table were gone, along with other paperwork. I trusted him and took him for his word and he screwed me. When I asked my trainer to confront him on this he told her I could come in 3 times a week for the rest of my 12 month period. The only reason I could do that was because at first I had missed sessions and had built them up to have enough to do that. He is a fast talker and a liar. So now I am in my 9th month leaving 3 more deductions. I am very concerned about my canceling and after reading all the other terrible experiences I have reason to be. Not only has Mike deceived me he has several other people, according to comments people have made to me. I think he is a top seller in the company and now I can see why. I don't blame any of the trainers and have had great ones, but they don't last very long because I think they are unethical to them too, from things I have heard. I also like Gold's Gym and have no problem with them. I would hope they would stand behind their customers that sign up for training, but by some of the comments I have read in this site, it seems as though they don't want to get involved. If anyone reads this when deciding to sign up with Beyond Fitness, I would recommend an independent trainer or someone who sells packages and not long term contracts because many things change in life. I found out later that they do offer different packages for a one time set rate, but Mike never even offered meany of those options. He was greedy and saw dollar bills when he saw me. So instead of appreciating my business he tweeked the numbers to cheat me out of sessions. Misleading me by constantly saying I could quit anytime with a 30 day notice. Even when I questioned that on the front of the contract, he gave me a spill about them writing it out that way to base all the fees on a term of 12 months, etc. Based on everything I have been through, I would never recommend anyone do any business with Beyond Fitness and it didn't have to be that way. I would have told everyone how great they could have been, but instead I am telling everyone how terrible they are and taking the time to write to this site.

Description: I joined this gym while it was being built. And as with ALL gym facilities you get a discount when you first up. This gym is NOT even two years old and it is FILTHY. I can not believe the condition of this facility. Not only had machines been down, TV's not in good repait, but the aerobic room is is in complete disrepair. There are holes in wall, the glass is busted and it is just plain filthy. Several people have commented to the staff to include the manager and the comment is "You get what you paid for" The trainers are not motivating. I worked in this industry for 13 years my self in several different states, until an injury prevented me from teaching for a while. I NEVER worked at a facility with the disregard for cleanliness and customer service that this company has. I have spoken with other members elsewhere and they all say the same things. The gyms are filthy and NO customer service or caring. My membership is a waste of my good money, because it is hard to go to a place that makes you feel so dirty when you leave. Let alone trying to take a class and when you have to go to the floor, makes you want to throw up!!!!!!!! This company should be sued and people's money refunded.

 Complaint
Business: Beyond Fitness
Subject: Company   NA
Description: I belong to Peak Fitness and in March of 2005 after two years of working out on my own, I decided that my independent efforts to obtain my ideal body were not producing results. A representative of Beyond Fitness, an independent contractor of Peak, approached me and we discussed what is entailed in their personal training program. I decided to give it a shot. I gave them a down payment of $279 which included the first and last month installment as well as a $39 processing fee. They were to take drafts from my account every month in the amount of $120. Like everyone else in the world I am extremely busy. I work full time, go to school full time, and have a number of other family and social obligations. At the beginning of August I finally had the opportunity to review my bank statement from June. Usually I glance at the statement comparing it to my check book searching for charges which are not suppose to be there. However the balance in my checking account was over what it was suppose to be by a couple hundred dollars and I could not figure out why. I poured over it for about an hour and finally noticed that my account had not been drafted for the $120 for Beyond Fitness. Immediately I phoned my bank as I assumed it was missed this month. They informed me that they never received the paperwork to take automatic drafts and it had never been withdrawn from my account. I could not believe it. I called Beyond Fitness right away to alert them to this fact. I left a message. Two days passed and I had not heard back from them so I spoke to one of the trainers. I asked him who I spoke with regarding a billing issue. He replied that it depended on what it was. I explained the situation watching his eyes grow wide. He guaranteed that he would advise the woman who handled the billing and she would contact me. A few more days went by and I still had not heard from them. I spoke to a different trainer and again explained the situation. The original person I spoke to came by and told me that the staff member (a manager) who originally filled out my contract neglected to input the routing number from my check on the paperwork to start the drafts but that it was taken care of. I wasn't sure what that meant so they advised me that I needed to speak to the manager and I should stop by after my workout. I finished up and went into the office. The manager was on the phone so I waited for 5 minutes or so until he was through. I went through the story with him while two or three other members listened. He could not believe that I was honest enough to bring this to their attention. Well, if I knew about it and did not inform them, that is not only dishonest it is also unethical. He said that he would not have pointed it out if he had been in my shoes. Interesting coming from a manager... Anyway, I told him that I would be more than happy to pay for services rendered but did not have the money immediately available. I would be able to give it to them in full in approximately three weeks. He said that he would contact corporate regarding this matter. He was certain that since I brought this fact to their attention they would be willing to work with me. I was to expect a call from him the next day. Four days later I showed up for my session and asked my trainer why his manager had not contacted me. He stated that he had to go out of town on short notice but as soon as he returned he make sure he contacted me. The following week, three weeks after I first contacted them about the problem, I showed up for my session and my trainer told me I could stop by the office afterwards to talk to the manager as he had returned. When we finished up I went into the office to speak to him and he told me that corporate wanted their money immediately. He gave me a choice between coming up with the $600 I owed or drawing up a brand new contract with another $279 down and he would prorate the sessions I had already used. I inquired as to what happened to the original money I put down and he told me that it was used for individual training sessions without a contract. That didn't make sense to me so I asked him to clarify. He sighed, stood up and ROLLED HIS EYES at me, got a blank sheet of paper and looked at me as though I was the biggest idiot he had ever come across. At this point I was rip-roaring furious. I had spent three weeks chasing them around to correct an error in their favor and this guy treats me as though I should be thankful he was talking to me at all!!!!!! Although I was disgusted with him I wanted to resolve the situation. I explained to him that I am an honest person (obviously) and I did not understand why I could not simply pay the money that I owed them in three weeks when I had it. He told me that corporate's problem with that option is that they are paying the trainers but no money is coming in. Say what? I see all of the other clients they have. Surely they have money coming in. Besides, ISN'T THAT WHAT HAS BEEN GOING ON FOR THE PAST FIVE MONTHS? He recognized that we had reached a stalemate at this point so he presented a third option. I could terminate my contract without any penalties to me but that my trainer would have the money he had been paid taken out of his check. My trainer had nothing to do with the incompetence of the other staff members. I could not in good conscience allow him to fall victim to this situation. I informed him that I would have to think about it. In reply he snapped that I was not allowed to train anymore until this was fixed. I was so angry when I left his office. My trainer contacted me later asking what had happened because he noticed that I was upset. I told him what was said and he apologized for the situation. He stated that his manager was feeling pressure from corporate about this and that he only had my best interests in mind. I responded by telling him that I understand that his paycheck comes from Beyond Fitness and he therefore must present them in the best way he can. However: 1.) his manager was nonchalant about the situation until he found it to be an urgent matter- I compare his attitude to those that work at the DMV, 2.) he treated me as though I should have realized how lucky I was to be in the same room with him- My time is as valuable as his is, 3.) when I asked him to clarify one of the options he had the audacity to ROLL HIS EYES AND SIGH- I understand English and am far more intelligent than he is and if I need to be treated like an imbecile I will attend a Mensa meeting, 4.) if corporate is so concerned about getting paid then why did they not return the contract when they realized the account number was missing, 5.) I am sure that corporate would prefer $600 in a few weeks as opposed to no money at all and thought that they might not appreciate his attitude towards clients- that was until I discovered this website and found out that they encourage rude and unethical behavior. I spent all day today trying to contact their corporate office. The 800-856-1232 (from the contract) number rings approximately 10 times before a voicemail picks up for Erica. I left Erica a message but did not hear back. I called back later and pressed 0 for the receptionist. A woman answered and became upset after I told her why I was calling. Apparently it is the wrong number. She was polite and gave me another number which was invalid. When I got home and found this website I tried a few more numbers. 770-261-5744 is for a vacant voicemail box. I reached Scott Higginbothom who instructed me to call the customer service number. When I told him that was the wrong number he said that it was probably due to it being late in the afternoon. I only discovered later that he was the Director of Operations. I am beyond frustrated at this point. I feel as though I have made every effort to give them the money due to them. Had I not been an ethical person they never would have realized that they were not being paid. I would like to terminate my contract with them without any repercussions in the form of either fees or negative credit reportings. I firmly believe after reading all of the postings that this company should not be allowed to continue to operate. If I treated my customers in such a manner my company would be out of business. Any direction or advice is welcome. I sincerly hope that someone out there may learn from my mistake. Research a company before you enter into a contract with them. Also check the Consumer Advocacy site as well as the BBB for complaints filed against them. FYI there have been 63 complaints within the last twelve months against Beyond Fitness. Compare that with 7 against my company in the last three years!

Description: I am a former General Manager of numerous Beyond Fitness's in the NC area who wants to first apologize on behalf of most of the honest managers, to anyone who has been mislead by managers at BF. First of all, the corporate office is a joke! Dont even waste your time dealing with the headaches! The Corp. Off. manager, Peggy Rome,(Randall Rome's mother), wont call you back. Just in case you want to try anyway, call 919-816-9853 or 919-816-9854 ext 123. Next, the company could care less about the MANAGERS OR STAFF, so imagine what they care about YOU! They constantly UNDERPAY employees which leads to the extremely high turnover! Check out www.fight-back.us for more info about the owner(s). Also, the gyms are NEVER professionally cleaned! Some dont even have toilet paper or paper towels because the company owed Carolina Janitorial Supply Co. so many unpaid invoices! Same goes for the Gym Tech co. who says they owe him over 20k for work completed! Most of the Trainers are UNCERTIFIED! They learn from experience. Hate it for you members with legitamate physical problems. As for the people who signed up for the Wake Forest club...I would contact the Atty. General today! Beyond Fitness is bonded for 500k. Divide that by about 65,000 members and you might get a whole cent when they go out of business! They are trying to get Capital Fitness to buy them out right now. I just wanted to give you all some numbers to the owners so hopefully you can get answers from the source. Randall Rome, primary owner-1-404-409-5551, or 1-305-345-1760, Thomas Flynn, minority owner, 1-919-337-5426, Joseph Garcia, Reg. Manager, 1-910-591-7379, or Roger, District Manager, 1-919-244-3445. I again apologize to anyone who suffer a loss of money, time, and patience with this company. I have since left the company and am persuing a lawsuit against the company myself which, because of the numerous complaints and physical evidence of improper business practices, have allow me to retain a attorney "pro bono", FREE! I suggest you call a lawyer immediately before this company closes its doors and ask the atty to take your case for FREE. Most of the lawyers I spoke with said they could easily make a case and would only charge me a percentage of the settlement. He said settlement because NC has very strict laws about record keeping, and monetary incomes, and if they cant present paperwork in a reasonable amount of time the fines start at 10k for the first instance. Trust me...I worked in the corporate S#%$-Hole...there is no way they keep records of draft info and other "STATE REQUIRED DOCUMENTS". Plus, did you know that BF sells its 2yr draft memberships to DUVERA CREDIT AGENGY & FAIR CREDIT AGENCY for cash upfront! Thats why you wont be getting a refund(unless you get a lawyer or news reporter). They also REQUIRE managers and sales people to TELL YOU that you are signing up for a 2yr membership...But after you leave, they will put 12mos+12mos FREE at the top of your contract entitling you to $0 if you cancel AFTER the first year! I hate this company because they made me lie to survive, and Ive seen SO many lower income people get burned when all they wanted was to get in shape! I truly hope that at least one person finds any of this useful. REMEMBER: DONT SIGN ANYTHING unless you read it ALL first! And if the offer is only good for "TODAY", I would pass it up. You have all heard the saying:"If it sounds too good to be true...It probably is!"

 Complaint
Business: Beyond Fitness
Subject: Company   NA
Description: I am currently a member of Gold’s Gym (Atlanta, Hard Rock), and had been training with a Beyond Fitness trainer from October 2004 through July 6, 2005. When I first started training in October 2004, I was assigned a trainer. As of May or June 2005, my trainer was transferred to another location pending an investigation regarding unethical activities. When he was transferred, I received NO phone call or notification of any sort. I had to make an effort to contact someone, left a message on the General Manager's voicemail (which was not returned), and had to physically ask one of the Gold's Gym employees who to contact to get this issue resolved. I was told to contact the NEW manager who apparently had been transferred to the Hard Rock location to manage the Beyond Fitness trainers. She agreed to resume my training, thus became the beginning of a wonderful trainer/client relationship. She was an awesome trainer, and for the first time while training with Beyond Fitness, I felt that I would finally see results due to her knowledge of personal training, dedication, and desire to push her clients to do their best. During the week of July 4, 2005, my sessions were cancelled by my new trainer (aka new location Manager) due to illness on her part. We agreed to resume our schedule the week of July 11, 2005. On Monday, July 11, I walked into the gym expecting to be trained at 6:30 p.m., just to be told by another Beyond Fitness trainer that she was no longer training (once again, I received NO phone call regarding yet ANOTHER trainer, for which I am a client, either quitting or being transferred), and for me to do cardio and that the General Manager would be in on Wednesday for my next session. After inquiring further, I was told that my current trainer had actually quit. I phoned the General Manager on Wednesday, July 13, 2005 (early afternoon) to find out what was going on, and he informed me that he would be at Gold’s Gym, Hard Rock location, on Thursday morning. I expressed to him my desire to cancel my membership due to being extremely agitated at the lack of professionalism of Beyond Fitness. He encouraged me to contact the corporate office to notify them of my desire to cancel my membership. Since my initial sign up with Beyond Fitness in October 2004, I have not been very happy with the service I have received. My first issue was in regard to Beyond Fitness deducting extra monies from my SunTrust checking account during the month November or December . Beyond Fitness was supposed to deduct only $280 from my account monthly. Instead, during the month of November or December, they deducted a total of $400. This truly put me in a financial bind during that time as well as overdrew my account. To keep that situation from occurring again, I closed that account and all future payments were sent directly to Affiliated Acceptance. Today is Friday, August 11, 2005, and I have YET to hear from a Beyond Fitness employee regarding assigning me a new trainer. Granted, I no longer want to train with a Beyond Fitness trainer, but I should have received a phone call from someone regarding the current situation of my not having a current trainer. I am into the second week of not receiving any training OR a phone call from a Beyond Fitness employee. I am pretty fed up with the treatment I’ve received from Beyond Fitness. It sickens me to continue spending my hard-earned money with a company that does not try to appease their clients.

Description: I entered into a contract for a qualified personal trainer. The trainer that I received lacked professionalism and did not appear competent. Even though I did not receive the training that I was promised, I lived up to the terms of the contract that I signed. When I tried to cancel the 'automatic renewal' on the contract, it was never acknowledged. Gold's Gym refused to give me a corporate phone number or corporate address for Beyond Fitness because they stated that the company was 'just a subcontractor'. They would only give me the local number of the trainers at their gym. When you called the number, no one answered. If you came to meet with them, no one was available. In March 2005, I hand delivered a letter to Gold's Gym/Beyond Fitness that stated I would not want to autorenew my contract and that I was very dissatisfied with the organization. In July of 2005, my credit card was again billed. When I called the only number available to me, I was told that they were only a collection department and that I would continue to be billed until I gave written cancellation. When I stated that I had, then the collection company told me that I would have to deal with Beyond Fitness. At this point, I am working with my credit card company to cancel my current card and reissue a new card. My credit card company has advised me to file a fraud complaint in order to have the July charges removed. I would recommend to anyone that is in a similar situation to work with your credit card company - IT IS YOUR ONLY HOPE.

Description: DO NOT SIGN UP for MEMBERSHIP! Beyond Fitness in Raleigh, NC and ALL of it's gyms are filthy! I have spoken to the manager at the Duraleigh location and he said I was speaking to the choir. He was frustrated too! The TV's are barely working. There is tons of dust on the tops and on the treadmills and elipticals. The pading on the weight machines needs to be replaced. The machines are never wiped down. The water fountains have gum on them and never get wiped down. I can only imagine the germs in the place. Go to another Gym!

Description: I go to the Beyond Fitness gym on Duraleigh Road in Raleigh, NC. The gym is disgusting! NOTHING is ever cleaned. I went in there first thing this morning to find the toilets clogged, so obviously the bathrooms aren't cleaned. The water fountains are caked with gook, and gum that someone left in there. They won't even take the gum out! I sure hope there is never an emergency, because the emergency door is probably sealed shut from cobwebs! Each time I go in, there are probably 4 or 5 employees, proudly wearing the Beyond Fitness shirts, behind the desk doing nothing! I even witnessed the emplyees steal CD's from a member, and then gang up on the member when he asked for them. Another member turned in 7 CD's that he thought someone left in a treadmill. Within 5 minutes of turning the CD's into the front desk, the owner of the CD's went to get them. The employees returned only 3 of them! They said they aren't responsible for things that are lost! Uh, stolen!!! I can't get in touch with anyone to complain, or at least to get the place cleaned. I could go on and on about the disgusting conditions. I am paid up for 2 more years, lucky for me!!! I wish something could be done!

Description: For all of you who are getting screwed by Beyond Fitness, Golds, or any other gym, stop and immediately cancel your credit cards. I had an experience with Golds where they were double billing me through credit card and company paycheck debit. I also got the runaround from their billing company, and corporate. I cancelled the credit card they were billing and filed a formal merchant complaint with Visa. I then hand delivered a letter to the club manager describing the actions I had taken and why. Within a month I had a check from Golds for the amount overcharged. Its a pain getting a new card, but desperate times call for desperate measures.

Description: I had purchased a trainer contract for 30 sessions for the Fuquay Varina NC gym. It took over two weeks to get my trainer and since then have had 3 additional trainers who either do not return calls to set up sessions, show up late to train you or do not show up at all. After complaining to the trainers manager, they said they would call me back. That never happened. When I went back to managment to complain again and tell them I want to cancel the rest of my sessions I was told that I would have to pay a cancellation fee. WHY should I pay a fee for the company's incompetence??? I have done everything to try and fulfill my end of the contract and they are now in breach of my contract and I am expected to pay. They have given the contact information for the coporate office but based on what I have read here I doubt that I will be successful. But I am going to try anyways.

Business: Beyond Fitness at Peak Fitness Matthews, NC
Subject: Company   NA
Description: On April 7th(Thursday). I spoke with Manager Paul Grimm at the Beyond Fitness at Peak Fitness in Matthews. Before I signed the contract I told him I was reluctant to sign up because it's been my experience that most trainers are either looking around and body watching or they are just not paying attention. Paul assured me they were a Professional Personal Training Company that was not like other training companies. I explained to him that I wanted someone strict because I was trying to get in shape for my daughters wedding. I had a month to start the process and he said it would not be a problem and could get a good start in a month. He said I could work with someone 2-3 times a week. I signed the contract in good faith. I told Paul I could come in the next day and he said he would be available Monday. I came in that Monday and Paul showed me some equipment I had approx. 30 minutes. Two days later I came in and I had a new instructor. I was a bit surprised (what happen to Paul?) My new instructor was good and once again I told him that I was very serious about training and that I had a month to get ready or at least get started on getting in shape for my daughter's wedding. This was on a Wed. When it came to schedule the next work out he said he had no openings between then and the following Monday as he was leaving on Friday for Indiana for vacation. (Of course by now, according to the contract, which said in order to be refunded, I would have to cancel within 72 hrs. which had past). Once again in good faith I went home and called my new instructor on the phone number he gave me and left him all the days which I was available (I told him anytime was good for me pretty much but that he could put me down for 3 days a week for the whole month at the times that worked out for him). The next week I did not hear from him. Now a week was gone in my crucial month of training. Paul Grimm finally called me and left a message asking me to call him regarding my instructor having to cancel my appointment. I called Paul back the next day at the number he had given me and left a message at Beyond Fitness. My phone call was not returned. Not only was the 3-day period gone (My contract only had 2 day grace period on it which I could of canceled) but also 3 ½ weeks of no show instructor and no returned phone calls had gone by and conveniently they had my money and I had nothing. I called my credit card company and told them what happened. They told me to cancel the card so that no more charges could be billed to my cc. and they would dispute it. So the process began to get my money back for a service that was not provided. I finally got a call from another manager from Beyond Fitness, Gerina. I explained what happened and that in good faith I had given them money and had every intention of fulfilling my end of the bargain but they obviously didn't have the same moral obligation to fulfill their end of the bargain. She told me that my Personal Trainer that went to Indiana on vacation never came back and she didn't know about it for a week or so later. However Paul knew and when he finally did call me and I called him back and left him a message, he never returned my call. She said Paul never returned my message (nobody returned my message) because the office was under construction. I told her that was not an excuse and that I did not receive the service they told me I would. She agreed with me and said what if I make sure you get a good trainer? I told her that the month that was the most important (before my daughters wedding) was over and that I did not trust them as a company. I told her I paid for a Personal Trainer (at $30.00 1/2 hr.) and I not only didn't get a Personal Trainer I didn't get a Trainer period. We went back and forth and I told her that their contract protected them but there was nothing to protect me. Gerina said she would have to contact Corporate but that she would get me a trainer but I would still probably have to pay $519.00. I told her I would be happy to pay Beyond Fitness for the two sessions I had recieved but that I would not pay them $515.00 and at this point my credit card company was disputing the charge and that I was waiting on them to contact me. I got another notice from Affiliated (Finance for Beyond Fitness) saying I now owed instead of $515.00 I owed $755.00. I then received a letter from my Credit Card Monitoring Service that said the Affiliated/Beyond Fitness had sent a charge for $2400.00 to Equifax. I never got a notice prior to this that this was happening. My credit is excellent and Beyond Fitness not only didn't provide a service but now they have resorted to ruining my good credit. I called the corporate office in Atlanta Ga and spoke with Shawn. I explained what had happened and he said I understand what your saying but you will have to pay 1,200 to get out of contract. $1,200.00 for two days of service. I told him he certainly did not know how I felt or he would do something about it. I asked for the owner and of course Shawn said he wasn't allowed to give me his phone #. Well imagine that someone whose willing to take undeserved money but is a coward when it comes to speaking face to face and owning up to their failure to provide what is not only expected but just due period! He makes his trainers do his dirty work. Shawn told me I had to go back to the trainer and talk to them even though nothing gets resolved at that end and must go through corporate. I did however go in and spoke face to face with Vince at the Beyond Fitness at Peak Fitness in Matthews. He said he would call corporate. That was on Friday. Monday I called Vince back to see what he had heard from corporate. I'm not sure he even called because he immediately said there was nothing he could do. I asked him what if I paid the $519.00 for first and last month as long as got a trainer for that money. His answer, well now I have some amunition to go to corporate with. No now you think $519.00 is better than nothing. That was Tues 7/25/05 I have not heard back yet. It should be me who is reporting them but unfortunately there seems to be no recourse for the consumer. I acted in good faith by providing trust, being available, calling and scheduling, not canceling and giving them my credit card. What I got in return was: Two 30 minute sessions, an instructor that couldn't fit me into his schedule, didn't set me up with someone else in the meantime, didn't return my call and when they did finally call and I returned the call I didn’t hear back form them till after a month. Their excuse, their office was under construction. Always excuses for why they didn't deliver. Who can protect the consumer? If there weren’t a consumer there would be no Beyond Fitness.

Description: I used to work for Beyond Fitness Corporate Office and I know first hand that it is a scam. The trainers only get paid commission if a client initials the Auto Renewal. the VP trains them on sales tactics that will keep you from not knowing what you are initialing. Because a client has signed and initialed the contract it is almost impossible to reverse in court. Many people call Customer service wanting to get to the President and Vice President and they would forward the messages back to me to call the client but here are their direct lines if you still want to call them President Steve Dow 770-261-5759, Vice President 770-261-5755. Director of Operations Scott Higganbotham 770-261-5756 and Director of Human Resources William Burke 770-261-5752. These people will more than likely transfer you to Customer service where you will speak with the Customer Service Manager. He is the guy that you can tell is gay when he answers the phone. He is not going to be willing to refund money or cancel a contract unless it is gonna cause the company Beyond Fitness to lose money. The corporate office puts a lot of pressure on these trainers to sign people up that is why sooooo many contracts are forged and the Auto Renewal is initialed fraudulently not because the trainer is trying to cheat you but because SSOOOOO many clients forget to send the letter of cancellation and they make lots of money off of this. Not to mention many dont know that they have 3 days to cancel the contract when they sign it but you will have to send the corporate office a letter and then they will make you send them a copy of your bank or credit card statement. once they get it they will make you wait 30 days before they will mail your check out to you to reimberse you. That allows your money to sit in their acct and draw interest. They literally make lots of money from this act. THE ONLY CLIENTS THAT I HAVE SEEN GET OUT OF A CONTRACT OR GET MONEY BACK ARE THE ONES WHO WENT INTO THE GYM AND DREW SO MUCH ATTENTION TO BEYOND FITNESSES PRACTICES THAT IS KEPT THE TRAINERS FROM BEING ABLE TO RECRUIT NEW CLIENTS.

 Complaint
Business: Beyond Fitness
Subject: Company   Misleading tactics
Description: I signed up with Beyond Fitness in Brentwood, TN on 1/29/05 for12 sessions per month for 12 months. At that time I paid $759 (1st and last month's payment). They began billing me, through Affiliated Acceptance Corporation, $360 monthly starting on 2/28/05. They subsequently billed me $360 on 3/28 and again on 4/28. On 4/7, I was involved in an auto accident, suffering a fractured sternum. That along with some other family issues led me to decide to stop training. I went to see Clint Mullen, the local representative for Beyond Fitness, at the Gold's Gym location in Brentwood, to discuss my options. He explained my 3 options, one which was to cancel the contract. He instructed me how to cancel the contract, writing on a piece of paper how much the 15% fee was, and giving me the address for sending the certified letter of cancellation. His explanation jived with what the contract specifies: "3. You may cancel this agreement at any time, provided your account is in good status, by providing a thirty (30) day written notice of cancellation, and paying a cancellation fee that is the greater of $250.00 or 15% of the total contract price." At no time did he mention, nor does the contract state that you must pay an additional monthly payment, in addition to the 15% cancellation fee. I never had any issues with Clint, as I felt he was honest and up-front. I mailed my cancellation request and cancellation fee to the office in Atlanta, as directed, on 5/17/05. They signed for the letter on 5/19/05. At the time I sent the cancellation, my account was in "good status", and I had paid them money that was equivalent to being paid through 6/28/05. At the same time I mailed my cancellation letter, I sent a carbon copy to Affiliated Acceptance with a note telling them that they should not be drafting any further payments, and referred them to Beyond Fitness. On 5/28/05, Affiliated attempted to draft $360 from my credit card. However, they were not successful, because I had lost my card and reported it to the credit card company, who promptly closed the account. Affiliated has sent me notice that I owe them $15.00 for a returned draft fee, which I will not pay. After playing telephone tag with Beyond Fitness, I received a call from the Atlanta office from a girl named Terri. She stated that they had no record of having received my cancellation request. After informing her that I had record of such, she asked that I fax to her the confirmation of delivery and a copy of my statement showing that the company had cashed the check. I faxed the requested info along with a copy of my original cancellation letter (after blocking out all pertinent account # info on my bank paper). She finally called back with no real explanation about what happened, but to say that I stilled owed for May's payment that they attempted to draft on 5/28. I informed her that payment was for 5/28-6/28 as they were drafting ahead, not in arrears, and that they already had my last month's payment, which they collected back in January. I continued to explain that in reality they already had money through 6/28 and since my 30 notice made my cancellation date effective 6/18, that they owed me for 12 days of June. She then tried to change her tune and say that the May 28th payment was for 4/29-5/28; that I was actually paying in arrears. I asked her, "If that was the case, then my double payment on 1/29 would have been for time that already was passed, where no contract existed. She also tried to claim that the last month's payment was only applicable if you fulfilled the full term of the contract. When I asked what happens to that money when you cancel early, and, in effect, she was saying that it is just lost and not applicable to anything. I told her they had more money than they were entitled to, by contract. If you buy their logic, there in no way to cancel the contract, giving them 30 notice, and not have to pay an additional month's fee. Your timing would have to be impeccable to have them receive the certified letter exactly one day before your draft date, in order for no further payments to be drafted. When I explained that their representative in Brentwood represented to me what I needed to do, not mentioning about any additional monthly payments, her only response was " that is not what the contract says." I said that's exactly what it says, reading her the line as stated above. The contract says "you may cancel this agreement at any time (emphasis added)", not only on specified dates. That means your 30 days notice could make your expiration fall anywhere in the month. It would also make sense that the last month's payment that is required up front, would be to cover such earned fees until the expiration date, so that the company would not get shorted intentionally or unintentionally. I stated that buying their logic meant that their representative in Brentwood mis-represented the contract, and should be held accountable for misstatements. Her attitude was it didn't matter what he did or did not say, that I still owed for 5/28. She stated to me that the contract was now not cancelled and still in effect. I told her if they didn't cancel the contract they were in breach of the contract. After a few more go-rounds, we preceded to hang up on each other. However, I did mention that I will let my attorney deal with it, to which she said, "You bring that attorney on." Basically I believe they are out to soak all the money they can from you and the way their mechanism is set up is to keep dragging on situations to allow them to draft more and more money. Even their automactic renewal process is geared, I believe, to have you slip up and get into another term without giving you a fair, equitable way of cancelling. I am looking to file complaints with the Better Business Bureau of Atlanta, GA; Nashville, TN; and for Sunrise Beach, MO (where Affiliated Acceptance is located). I would like this to go away but I will look into legal options, including seeking to have the entire contract declared null and void, requesting the complete refund of all my monies, plus costs, and punitive damages. I would like to hear from others who have and are experiencing the same problems, and ask is there any way to band together to put an end to this kind of business tactic. I still have my contract with Gold's Gym, though I'm not sure I will continue it. However, they have not presented any problems for me so far. Anyone interested in reaching me can do so through email at jtacompute@hotmail.com

Description: My husband has worked out at Gold's Gym FOREVER! He decided to take up a second job training there for Beyond Fitness. That was the biggest mistake ever. If you are wondering why you are always getting a new trainer and why they are always quiting, it is because that company is as big as a joke to work for as it is to deal with as a business. He quit about a month ago because he was still owed 2 paychecks, which he still hasn't received and we are sill getting the run around about. I am filing a complaint tomorrow with the Labor Commission. They also only pay there trainers $7 a session out of the $30 - $45 you are paying. If a client decides to cancel there contract they subtract $50 from their trainers paychecks. My husband was also told that he could make commission for signing people up with training sessions, he sold a lot of contracts and never received one penny from Beyond Fitness. STAY AWAY FROM THIS COMPANY, and hopefully Gold's Gym will get the picture that this company is a bad business partner to have.

Description: I have been an employee of Beyond Fitness Personal Training Company for almost 2 years. I was recently hired to work for Beyond Fitness Gyms at the same location (Fuquay-Varina, NC) In the time I have worked for the gym, I have spent countless hours working to change the reputation of the gym and of its employees. I currently hold 2 ACE Personal Trainer Certifications, and am pursuing a Master's Degree in Nutrition. In the time I have been employed at the Fuquay Gym, I have met hundreds of people and listened to both positive and negative complaints about both of the companies I work for. I can honestly say that I love my job. I love the people that I train, the members at the gym and I love the facility. I would like to make a suggestion to anyone contemplating joining Beyond Fitness Gyms, or hiring a Beyond Fitness Personal Trainer. Please READ THE CONTRACT BEFORE SIGNING IT!!!! As with any contract, you are responsible for everything contained in it after you sign it. When it all comes down to it, you are responsible for what you sign. I have always been up front and honest with everyone I have helped join the gym and hire a trainer. I inform them of the 3-day cancellation policy, and of the auto-renewal clause in the training contract. I also let them know that both the gym and the training company use a separate billing company, and that once your contract leaves the facility, all of the billing is done through this company. I want to apologize to those who have felt misled or lied to. I know that in my club, and with my clients and members, those things don't happen.

I told the trainer Rick (who happened to be the General Manager of the site on 7800 s Redwood Rd) that I didn't get paid for 2 weeks, so we couldn't do it. He said that it took about 2-3 weeks for a contract to go through not to worry about it. I told him it wouldn't clear, he had to be sure & he GUARANTEED me up & down it wouldn't go through. The check went through a week & a half earlier than it should have. The General Manager (Rick) tried denying it & wouldn't take any responsibility for it. They also flaked out on us twice with our sessions so we haven't even gotten one session. I have been fighting with the District Manager as well as Edward at corporate. All I wanted was my money back (including the overdraw charge from my bank) & let out of the contract. They haven't addressed the fact that a GM can lie through his teeth to our face & not have any concequences for it, that their employees have no concept of business ethics or morals. Description: I have read the complaints about this business and just can't believe this place is still in operation. I thought I might be the only one. What a joke. The organization simply reeks of incompetence and low quality. I signed a 2-year membership, which was to be billed in 3 equal payments in 3 consecutive months to my credit card. Then 14 months AFTER my final payment, I get a notice that I still owe another 4th payment. I called and talked to some sort of rep. Then I wrote to them explaining this was not the case. Three months later I get a collection agency statement. What a joke of an organization, business, and individuals. When it comes to this place, I suggest that you hold on to your wallet and run. Run far and run fast. I look forward to their demise and the closing of their doors.

Business: Beyond Fitness/Gold's Gym
Subject: Company   NA
Description: I am a member of Gold's Gym and recently (06/05) I signed a 1 year contract with Beyond Fitness for a trainer to help me pass a physical agility test needed for a job. While speaking with the trainers about my fitness needs, I realized they had there own agenda and did not care about me passing my physical fitness test. I decided to cancel my contract within the 3 day grace period. I read over my contract which stated that I need to provide written notice to the "seller", but it did not state who the "seller" was. I wrote a letter addressed to Gold's Gym and Beyond Fitness to cover my bases. I also included a number where I could be reached in case of any processing problems in this letter. I turned it into Gold's Gym on the third day and TWO DAYS later a trainer, Cody, called me to say that I needed to send it to an address in Atlanta - he also gave me a number. I called the number and got a Shawn "No Last Name" sleaze bag. I asked to speak to his manager, Edward "No Last Name". When Edward would not help me I asked for his manager, he said it was the president of the company and the president does not take phone calls. Edward informed me I could send I letter to the president, but it would come across Edward's desk anyway. Now I have to pay the 200.00 down payment that they WILL NOT return and a 250.00 cancellation fee. I have NEVER even had one training session and judging from the previous complaints on this site, I will not benefit from getting one. I also called Gold's Gym, they said they could not and would not do anything about this because Beyond Fitness is LLC. I am worried Beyond Fitness will keep billing me, I am reporting them to BBB and Utah's Consumer Protection. Is there anything else I can do? I have never been treated so poorly in my life by these 'men' in Atlanta. I would not recommend Gold's or Beyond Fitness to anyone.

Description: The Spring Forest Rd, Raleigh NC Beyond Fitness has been disgustingly dirty. I think it's unhealthy. Where do we report such conditions? There are moisture and probably mold problems in there, unsanitary bathrooms, equipment isn't cleaned, wiped down or even dusted. Wt machines missing metal pegs - how hard can it be to replace these? Long ago they also wrote 2 people up on one contract, then only "showed" they had one of us as members. Hang onto your contracts and make sure everything is put in writing. Even after another renewal THEIR records weren't indicating I had a membership. I had to go back in with a copy of the contract again! Another Beyond Fitness hired a trainer, paying them only one half of the salary of what they said they would (not counting commission or such). Think there must be problems at the top??

Subject: Company   health club training, billing & cancellation concerns
Description: I personally have not had any problems with Beyond Fitness. Although, I have not been to the gym in months, I accepted the fact that i burned those training sessions i paid for, never making appointments and agreed to the terms of my contract. I've maybe attended 4 sessions at the most in a 1 year contract. I was given an AAC (Affiliated Acceptance Corporation) Fax and contact # by Beyond Fitness @ Gold's Gym in Palm Desert, Ca. My term is up soon. I faxed the number i was provided (573-374-9972) with a request of cancellation to the automatic "order of renewal". i also called 1-800-233-8483 and spoke with a representative of AAC that confirmed my fax had been scanned and is being processed. The rep told me that after my last payment, i will no longer be billed because i cancelled automatic order of renewal. I suggest calling these numbers i provided as they are the ones that are debiting our accounts (check ur bank statements). so far, everything is on the up and up. I will also be sending a certified letter to both, BEYOND FITNESS PO BOX 420460 ATLANTA, GA 30342 and AAC PO BOX 790001 SUNRISE BEACH, MO 65079-9001 ... just in case ;) i checked BBB.org and LABBB.ORG lists Beyond Fitness as an: "F" (We strongly question the company’s reliability for reasons such as that they have failed to respond to complaints, their advertising is grossly misleading, they are not in compliance with the law’s licensing or registration requirements, their complaints contain especially serious allegations, or the company’s industry is known for its fraudulent business practices.) this is very unfortunate. ive checked out all listed BEYOND FITNESS (corporate and centers) i believe there is only ONE in texas.. that has an okay rating which is 2 complaints, 2 resolves. i hope i dont have as horrific stories of cancellation problems you all have had to deal with and i hope the info ive provided can help resolve a problem for someone who is reading this comment. good luck to you all.

Description: I Joined Beyond Fitness last year. They did not provide any of the services that they promised. I had two of my trainers quit during the year. I did not benefit at all. Upon attempting to cancel my contract, I sent a certified letter to the address in Atlanta that I was provided by a Beyond Fitness representative on April 8. It was signed for and received on April 11. I received a letter from their billing company 3 days ago notiying me that I owed them $90 plus May's membership fee because they attempted to withdraw my membership and were unable to because the account had been closed. I provided them with the proof that my certified letter was received over the 30 days in advance that they require. They then tell me that I sent it to the wrong headquarters (Atlanta's and not North Carolina's) (Big Deal!!!) so it is like they never received my cancellation request. And not only is my membership not cancelled, but I am now too late to cancel by June so I will owe June's membership as well. All because I sent it to the address I was told to send it to and now they claim that was incorrect. Now they will not return my calls and when you do get ahold of someone they pass you around from person to person so you can't get anything resolved. This company is ridiculous!!! Please Help

In the later part of the month of 8/05 I became ill when while working out I started to have breathing problems (I have cronic Asthma) I contact the gym and was told to complete a release form. It went on for several months and I thought everything was handled. I recevice a letter from a collection agency stating they were going to start collection/judgment procedures if I did not pay. I have provided the needed information that was requested from my Dr.s office. They keep coming up with little things and are still threating me. They closed there doors (this was on the news) without notice in 2/05. They reopen a few days later. Now they are closing again. If this place closes there doors without notice is that not a breach of contract. I am at wits end as to what to do next.

I as her mother had to get involved because of the 16 hour time difference. Consequenty they said they will no longer debit her card, but they will NOT refund her money. She is in all kinds of financial trouble because of this and they basicly DO NOT CARE. She is serving her country in Korea and they basically said TUFF, you signed the contract and you will pay the money. No one at the gym told her she needed to write a letter to cancel, and everytime she called no one told her she needed to write corporate. I am very sad and unhappy, and my daughter is getting poorer by the month. I wish someone could help her, but I don't know who to go to. HELP! A Proud mother of a U.S. Airman serving her country.

Description: Like many of the dissatisfied in Greensboro, I was a member of Beyond Fitness/Golds Gym. I paid for my membership in full expecting the contract to be fullfilled when the new gym opened. Of course, that never happened and since closing their doors, some shady dealings have seemed to occur. I recieved a letter stating 2 options: continuing my membership at the old gym or getting a refund on my membership. I chose the refund, filled out all of the proper paperwork and even sent the letter certified mail as requested. The letter also stated that my refund would be processed within 30 days....that was months ago! I have called many, many times only to get the voice mail of someone who doesn't return calls. Whoever mentioned in one of the previous complaints about ext. 121 and 123 was dead on! I am a single mother who could really use the refund at this point. Description: Just wanted to let people know that the customers of Beyond FItness were not the only ones who got cheated. I worked for the company when they first came to Palm Desert, CA Gold's Gym in 2003. When they started hiring trainers who had never trained even a dog, I was a little suspicious. They did not care or require the trainers to be certified. They said that you could get a trainer certification from them, which was a lie! They have no business license with the city. They short employees'pay checks, which never arrive on time. They operate under different business names, so thats why you can never get a phone number to contact them. The "corporate" people never come to check up. The businees just wants you monthly income and they don't care about the customer or employee. They train you to sell training sessions, even if its not what the customer wants. I can't believe GOld's GYm still allows this company to operate under their roof. Business: Beyond Fitness (aka Golds Gym), Cincinnati Oh and Atlanta GA
Subject: Company   Failure to honor contract
Description: I had a contract with Beyond Fitness in Cincinnati and due to hernia surgery was unable to use personal training sessions for several months. I attempted to contact the local office to explain I would need to extend my contract for medical reasons. No one from the local office ever called me back, although I left 3 messages over two weeks. After my surgery, I stopped into the Golds Gym where the local Beyond Fitness office is located, on several occasions, but noone from Beyond Fitness was ever there to answer my questions. At this point, I sent a certified letter to the corporate office in Atlanta, saying I would no longer pay as they had breached their contract by refusing to provide services. I know they received the letter, but no one ever called me from the local or Atlanta office. They did however, continue to bill my credit card account. I contacted their billing office twice in the next two months. The billing company asked me to fax my drs. statement and explanation, which I did. Again, I never received any acknowledgement from Beyond Fitness. The next month when I received my credit card statement, I called the billing office again and the person there told me they could stop billing my credit card account. I also disputed the charges with my credit card company. It was only AFTER I stopped making automatic payments that Beyond Fitness contacted me to say I owed them money and the contract continued to be in force. I asked them how I could expect to receive any services, when they had failed to make any attempt to provide the services for the past four months, and had ignored my attempts to contact them, UNTIL THEY STOPPED RECEIVING MY AUTOMATIC PAYMENTS. I am still disputing these charges, as of course, they continue to send me regular bills. Their customer service has been consistently poor at best (since for the most part, they simply fail to respond to any attempts at contact). I will continue to dispute the charges, as they have failed to provide services. The people I have managed to get on the phone have been rude and insulting. I intend to file a complaint with the Better Business Bureau as well. I would advise everyone to AVOID this company completely, as they cannot be relied on to provide the services they contract for, and then continue to expect the customer to pay. This is the worst experience with any corporation I have ever had, and I will avoid both Beyond Fitness and Gold's Gym, and advise everyone I know to do the same.

Description: In October of last year, my wife and I purchased a contract with Gold's Gym in Spanish Fork, Utah. At the same time, we entered a contract for training services with Beyond Fitness, but immediately determined that we would be unable to fulfill the terms of the contract. As specified in the contract, we notified Beyond Fitness within 72 hours that we were cancelling the contract, and the trainer that we worked with said he would take care of the matter. In January we were made aware that Beyond Fitness had sent our account to collections and reported the collection account to the credit bureaus. We subsequently found that the trainer that we worked with is no longer with the company, and in speaking with their "customer service" staff have found the company totally unwilling to deal with us in a fair manner, even though we met the terms of the contract that we signed.

Business: Beyond Fitness/Gold's Gym South Beach
Subject: Company   Credit Card Fraud and Harassment
Description: I would like to report some fraudulent and unconscionable behavior by a franchisee. I joined Gold's Gym South Beach on March 11, 2005. At the time, I was told that the amount I paid upfront was fully refundable if cancellation was made within three (3) business days. I understand that this is not only written in the contract, but is also the law in Florida. I am a young single girl. I inquired about the type of members who belong to the gym. This was for no reason taken as an anti-gay prejudice on my part and thereafter the management subjected me to unprovoked insults and illegal unauthorized use of my credit card. After I cancelled within the permitted three days, the gym refused to honor this cancellation policy. Instead, after telling me I was no longer welcome at the facility, they charged my credit card an additional sum (which seems to be an entire year's charges), as a retaliatory tactic. I understand that had I not rescinded the contract, the gym could have charged me for the next month on April 1st, but under no circumstances were they given permission to charge my card on March 21st, and certainly not for an entire year. In addition, last night I received a threatening e-mail that was not only filled with false accusations and chronologically inaccurate information but also a gratuitous insult and veiled threat concerning my physical well being. This constitutes illegal action, and I am sure it is in violation of the franchise agreement and my rights, as well.

As seen on News 2 they closed the gym down in the middle of the night and let members go else where when the entire time they would tell you we are not shutting our doors. They were suppose to be in contract with AC Fitness, which defaulted. I closed my bank drafts the next day. for I was going on medical leave for 2 months, and I knew there would not be a chance for me to take care of any business during a healing time..I have now received a bounce fee from the Beyond Fitness collection co. that my draft failed and I had to pay it plus the month it was due. The gym did not honor their contract with me when they closed, why is it that people like me have to pay for bounce fee's, when they had no intention of keeping the gym open, it just happened the Atty General come into the picture and they reopened. We still have no tanning bed in this facility, no one with a certificate to run the tanning bed.. no training staff, no cleaning crew, very minimal staff to run the place. Yes I have very hard feeling towards the gym..and I am still a member today, only for my free months, that I received for referrals to a once nice place to work out...But now a horrible experience. You do not know from day to day if they corporate employees will talk to you, they do not return calls. so Try this # and see what you get 919-816-9853 ext 123 or 121...I bet just voice mail or excuses.

Subject: Company   Horrible gym
Description: I received a mailer stating a new gym was coming to the neighborhood. I immediately enrolled b/c it was an unbelievable offer. The new facility would open in April of 2004. April rolled around; no new gym. It is now, March 2005. The gym closed abruptly in late February. They also mailed letters stating our memberships would be honored by AC Fitness on Market Street. AC Fitness confirm they were trying to work out a deal but the talks fell through. I also inquired about terminating my contract due to their failure to open the new gym. I was told the I could cancel but they would not refund my money. The facility is cramp. The equipment is old and rundown. Machines have not been fixed in over a year. I wish UNCG would allow me to purchase a membership there.

Description: I have been a member of Lifestyles 2000 in West Jordan, Ut. for about 3 Years now. When it became Golds Gym I was excited for the extra perks that I thought would come with my membership. Turns out I was wrong because I am not allowed to go to the new locations that have the extra perks in them unless I upgrade my membership. Also They have different less convenient hours now. The one good thing about the West Jordan, location (old Lifestyles), is that the New General Manager for Beyond fitness is the best trainer I have ever had. He knows what he is doing and he truly cares about his clients, which is more than I can say for the actual training company. They do not care about their clients or employees they only care about making money. No wonder they have such a high turn over rate. If it had not been for Derek I would not have signed up for a training package ever again.

Subject: Company   I Want My Money Back
Description: I live in Greensboro, NC and I have had a membership with Beyond Fitness for about 7 months now. My contract is for 3 years. On Monday, February 21, 2005, both Beyond Fitness locations in Greensboro closed their doors, leaving all their Members out in the cold. I need to know how do I get my money back from Beyond Fitness, since I have a contract for 3 years and I've only used 7 months. I have tried to call the corporate office but I can not get in touch with anyone. They have no means to speak to anyone in the Corporate Office.

Subject: Company   Beyond Fitness "No Customer Service" and contract issues
Description: My contract ended with Beyond Fitness in Nov. '04 so I signed up for a new contract for the next 2 years. The problem is they are still charging me monthly from my old contract. I sent in a cancellation form for the old contract (with copies of both and a letter explaining my situation). I have left many messages and no one has returned my phone call. The gym location didn't even have a copy of my contract. It's a big, aggravating mess. Who do I talk to and how do I take care of this?

 Complaint
Business: Beyond Fitness
Subject: Company   customer service
Description: In August 2004 I signed a 1-year, two-times a month contract. In November they got a new manager who wanted to introduce himself, and I told him I wanted to pay off my remaining sessions (so I wouldn't feel guilty about taking my sessions closer together). His manager, Sheri, was there and said I could pay for the 16 sessions in full, and send in a notice of cancellation for the monthly charges. I did as she told me, only to find out later that I was still being charged monthly. I spoke with Sheri, who said I had signed a contract for an additional 16 sessions which was paid in full, but I still had the first contract to fulfill. I didn't want more sessions, and I explained that to her. The new manager completely understood what I had wanted to do, and from Sheri telling me to send a certified letter to cancel the first contract, I had believed she understood also. But instead, she signed me up for more sessions. I've dealt with the corporate office, trying to get them to void the second contract, but they aren't interested in good customer service. They just want your money no matter how dissatisfied you are. P.S. From August to December, I've trained with seven different trainers!!! Beyond Fitness has an extremely high turnover rate at the gym I go to, which tells me their clients aren't the only ones dissatisfied!

Subject: Company   Contract Dispute
Description: I had a 1 year contract with Beyond Fitness out of Gold's Gym in West Jordan, Utah. In the contract there is a "required" auto-renew clause. The only way to get out of the contract is to send a certified letter 30 days prior to your withdrawl date from your checking account or credit card, which is the only way they accept payment. By the time I realized they were still taking money out of my account I would be into the 14th month. It was extremely hard to contact anyone who could answer my questions. They were unwilling to help in any way. If you are considering signing up with Beyond Fitness, don't do it. It will end up costing you more than you think. I don't know why Gold's Gym allows them to work inside their Gym.

Subject: (Other)   Personal Training Services
Description: Beyond Fitness @ Gold's Gym West Jordan Utah is a business of poor report. Their trainers were never available when I was. Over a year's time my wife and I were able to meet with a trainer (never the same one) 4 times. After a year I decided to cancel the service and contract. I inquired of the manager for Beyond Fitness West Jordan as to how I was to cancel the contract. She, her name is Cheri, told us all we had to do was put it in writing and she would take care of the rest. Three months later they were still exercising the EFT from our checking account. The company withdrawing our funds would not accept the letter of cancellation because "It was not submitted per instructions on the contract". So now I have to pay this disreputable group an additional $85.00 to get out of the contract. If you are looking for personal training while at Gold's Gym don't do it!!!!!
