Sun Spots Realty - Surf City

    The Consumer Advocate Warns "This merchant has many, many, many Un-Resolved Complaints on file, (due to legal issues the former owners were not permitted to specify). In their esteemed wisdom, this merchant decided to hire a lawyer and sue the former owner for posting the information, rather than resolve the issue!!". How Quaint
    However that ploy had not stopped Dunn & Bradstreet from being contacted by other victims of this vender, or other "victims" from continuing to contacting this site with their horror stories perpetrated by Sun Spots Realty.
    The complaints range from simple "Non-Payment" of their suppliers, sub-contractors & other help, to the outright theft of several thousand dollars and lost sales from former customers or clients. 

PS. - Our Legal Department is preparing to meet "Sun Spots Realty" in court, along with some of the victims whom have posted complaints here and/or at Dunn & Bradstreet.

The Easter Motion    And the lunacy continues, on Good Friday, March 25, in the late afternoon mail we got a "Motion for Judgment", filed in Pender County, North Carolina, and sent in a New Hanover County Court Systems envelope, over 500 miles away, for us to respond in 7 days to, beginning on March 23. We are to file a written response to a complaint we Did Not Get A Copy of", yet we are to file this written response within the seven days of filing. Now our Easter weekend is to be consumed by researching the legalities of a bogus complaint, that we do not yet have, so we can file a written response to in a county where, we do not now, nor have we ever, lived or had a business.
    We are licensed in Tennessee, we live in Tennessee, our business is in Tennessee, any suit should be filed in our county of business, and or residence. Since it is a bogus issue, I am legally entitled by the First Amendment to publish what I believe to be the truth, and can document my resources of without retribution. This lawsuit is a frivolous waste of our time and your tax dollars by a couple of greedy, oxygen wasting sacks of carbon masquerading as humans, that happen to own a corrupt real estate office.
    I will be scanning and making available to you the "Motion" in the next couple of days, and to think I was about to move this issue to the archives as an "old inactive issue", boy was I ever wrong about that. These morons will not let it die. Apparently they are consumed by ignorance?, I am not really sure what motivates these lunatics.

    All outward appearances indicate that they are attempting to force a "Mediation" since the "complaint" could not be filed in a real court. This is Not Acceptable to us or any of our visitors. Any mediation pushed through a kangaroo court with only the "plaintiff" present, choosing the mediator, and in the plaintiffs back yard, is truly a joke. It represents a travesty of the justice system enacted by our forefathers.

    I was contacted by ABC News to see if the "Suit" had progressed to an actual date in a federal court. Since it had not, they asked if we could contact them in the event the Anderson's attempt to pursue it any further. It seems that First Amendment Issues are of interest to the nation, and are National News worthy.

August 10, 2004 -
The Greene County Sheriff's Department "Served" the suit

    A week after I went to Iowa for 7 weeks, on another project, the Greene County Sheriff's department served the "Official" law suit to my wife. In the course of the action, the deputy who actually brought the papers to our home, upon inquiring about the nature of the action, thought it was a joke! He could not believe the insanity of the suit itself, or the audacity of the Andersons for filing it.

July 29, 2004 - The "Draft" Suit

  1. Scanned copies of the "Draft" lawsuit, all 24 pages, including the search engines listings and, of all the lunacy, the inclusion of the search engines in the "Suit" since they, "have the audacity to index the information". These are listed as thumbnails and posted as images, they are scans of the actual pages sent to us via registered mail, all six copies.

  1. Scanned Copy of Original Letter from Anderson's First Attorney in Surf City, North Carolina from 2003. It demanding that any information, "concerning, related to or mentioning, Sun Spots Realty or the Andersons", be removed from the website or "face further legal action".
        Since we were living in the area at the time, in the interest of "Community Harmony", we basically complied. We removed the names and complaints details, however if we were specifically asked, "I am Not Going to Lie to Anybody, plain and simple", Sorry!! The details have been available here in our office, I wouldn't post them or send them in the mail, postal or email, before the "Lawsuit Draft" anyway!
        That all changed on receipt of the Newest Suit. July 23, 2004.
  2. Since we are currently in the process of locating property, the property we intended to purchase initially simply had too many "flaws" to pursue, most of our records are still boxed and stored. However as we can locate the "Hardcopy" each of the original complaints will be made available to our visitors as well. Hence, the most recent complaint dated "May 12, 2004", at the bottom of this listing!

And So here we are on July 23, 2004

    Today we received the "Official" Lawsuit "Draft" demanding that we remove the "Truth" from the website. According to the Anderson's everything we have posted, everything people have submitted to us and everything we've received from Dunn & Bradstreet, is all fabricated lies. Gene Anderson is the only person involved to tell the truth.
    As Soon As Possible, I will do my best to get the scanned copies of the lawsuit "Draft" posted here for you to see for yourself.
    Must Not Tell The Truth!! -  Not any infringement of the first amendment there is it?

    This is the same incident that one of the Sun Spots employees called and asked us to take a settlement of less than the bill because, "Bobbie Anderson will spend however much money she had to to not pay the bill!", that same sentiment expressed by Bobbie Anderson herself, on the phone to our office.

NOTICE:    As of July 8, 2004 we have received several messages from "Sun Spots" concerning, Not the Complaints themselves, rather the Issue of Our Posting Them Online for other consumers to see, read and decide for themselves. . . .

Our reply is simply this . . .
    Seems as though the Anderson's are still more interested in "Gagging" anybody who might "Dare to tell the Truth" about their company's business practices, rather than simply resolve the issues with the parties involved.
    Point to point, If we were "Running or Hiding" do you really think we would post our Name, Location, Phone Number, and contact information all over the net, on our company site, in addition to a dozen of the sites we manage? I think that if I had any interest in hiding, I would not be posting contact information on anything, let alone dozens of places.
    Apparently relocating to the town my grandchildren are living in is "Running and Hiding". That must mean that "Sun Spots Realty" is devoted to facilitating people to "Run and Hide".
    So who are the Andersons' "Running From", they are, after all, transplants to Topsail. From where, no one knows for sure, you certainly won't find an "About Us" section on their website. "About" is standard on our site, all of the sites we manage and any site that operates "Above Board", or simply put, any site or company that operates honestly and with integrity. All you can find out about the Andersons' is that they started in 1999, they have an office phone and three locations. The Andersons are apparently "Running & Hiding" from someone as they only "Appeared" in the Topsail area from parts "Unknown" in 1995!
    How many honest people do you know, that can go from little or nothing to New Cars, New homes, and several locations on an "Honest" profit, wage or compensation??
    If you really want to "Sue Us" for telling the truth, the facts are as documented. I personally could not care any less about the few dollars they did not pay my company, two years ago.
    I have moved on to more important things, such as time with my grandchildren. As far as I am concerned, we bought their soul for $270.00+/- or whatever the ridiculous amount was. It was not worth pursuing two years ago, when we canceled the "Collection Proceedings" at Dunn & Bradstreet in April 2003, and it is certainly not worth looking it up now.
    Since I no longer live in the area, their threats are simply a good laugh around here. For the sake of those companies and individuals whom have filed complaints, that still live in the area, I will continue to uphold their anonymity. Especially, since most of them are the "little people" in the area whom can not afford the attorney fees and legal wrangling that the Anderson's are known for. These "Little people" are the ones that do most of the "Grunt" work in the area, the hard working construction workers, self employed contractor, and the other small business owners considered to be "Beneath the Anderson's Social Class". In other words, the regular, everyday people that work for a living.

On July 7, 2004, we received the following message from Mr. Anderson with the  . . .
    Subject line: Fw: Lying, No-Good Bastard

Mr. ######:
    Just a brief note to let you know that we have instructed our
attorney, Kate Fairley of Surf City, NC (910.328-3515) to proceed with a
libel suit against this lying, no-good bastard.
    His is the only complaint we have ever had, and out of charity we partially
paid his bill for virtually screwing up our entire computer system, and had
a pay a second computer expert far more than this guy's bill to remedy the
situation.
     I guarantee that any other complaints are entirely his repeated time and
time again. Feel free to check with Dun & Bradstreet.

    Since we only filed one report, the collection action that we later cancelled because it was not worth the cost and aggravation of dealing with these two belligerent, obnoxious, creatures, any and all other reports made to Dunn & Bradstreet had to be made by other "Victims" of Sun Spots Realty!!!

    As a side note, we canceled our collection proceedings at Dun & Bradstreet in April 2003 and simply considered the frivolous amount, not worth pursuing, it would cost more in legal fees to collect than it was worth. I can sleep fine at night knowing that I did my job, above what was required, and have the invoices and work orders to prove my point.
    We stopped any work, or further contact with these people, and I use that term exceedingly loosely here, when Mrs. Anderson got belligerent on the phone with my wife. I do not care who you are, I do not have to do anything for anybody that has or shows so little respect for my wife or any other human being.
    I have been in this industry since 1978, and in business as "Sound Trax" since 1979. My reputation is well known, well documented, and well respected throughout the industry. I, my wife, nor any other self respecting human being, treats other people in that manner and I Will Not Tolerate It from Anyone. If you want to get belligerent, get someone else, it's that simple.
    Their few measly dollars are so far from the issue, the issue being as my grandchildren say, "Treat other people like you want to be treated, and above all else, 'Tell The Truth'." It's that plain and simple!!

    In viewing you site I found several indications of complaints with Sun Spots Realty. Can you tell me what the complaints are? Would like to know more about them before I choose to do business with them.

On July 2, 2004, we replied with the following . . .
    Concerning "Sun Spots Realty", the owners of this company have a reputation for "not honoring their commitments", across the board, not paying sub-contractor, not delivering fees to owners, not returning renters deposits, charging renters for previously damaged property, etc.
    As for the specifics, we are currently restricted by a "gag order" imposed by Sun Spots attorney that prohibits us from divulging online, the actual complaints. We are not prohibited from showing them to individuals who may be in our office and happen to pick up the complaint listings. The owners choose to pursue a "Gag order" on our company, rather than resolve the issues that have been sent to us by other former clients, customers and sub-contractors.
    I can say that my company did some computer work for Mrs. Anderson in 2001 that we have not yet been paid for, part of the 'Gag Order" was intended to prevent us from divulging that fact "Publicly".
    However, we have on file several other "former" sub-contractors that the Andersons handled the same way, i.e. Refused to pay for services rendered, and would hire an attorney and sue the sub contractor rather than simply pay what was duly owed.
    As members of Dunn & Bradstreet, we have received 23 notices from D&B that other businesses and customers have filed complaints against "Sun Spots Realty".

    They cost us $7,000 in expenses and loss of a purchase when property was still available to select from at a good price. The realtor promised us attorney help because we were treated unethically and illegally. at the last minute we were told he could not help us and if we did not accept our deposit back with in the hour we would lose that also. we were out of town and without legal council-treated rudely and insulted by the agent. told our phone calls had been taped without our knowledge and consent and yes we made several angry phone calls. Working with this agent was the most costly mistake we have ever made business wise. not even a apology but lies to other professionals and a complete nightmare to work with. - "burned",
